Introduction.
Unity Corporation, Inc., (“Unity”) provides software as a service platforms including “jLog”, “Ask an Expert”, “Smart Assessment Tool”, and the “WonderBar”, (collectively the “Services”). These Services are available to users directly through websites owned or operated by third parties through which you may register, to receive, display, access and/or download a branded version of the Services (each a “Subscriber Site”, or collectively the “Subscriber Sites”).
What This Privacy Policy Covers.
This Privacy Policy covers how Unity treats the information it collects through the Services, from which this Privacy Policy is displayed or linked.
A Subscriber Site’s use of information collected through its branded Services are set forth in each Subscriber Site’s Privacy Policy displayed or linked from their branded Services, or through means of Supplemental Disclosures to this Privacy Policy.
By registering for and accessing the Services that link to or display this Privacy Policy you hereby accept the policies and practices described in this Privacy Policy. Each time you register for, access or download a Service, you agree and expressly consent to Unity’s collection, use and disclosure of the information that you provide as described in this Privacy Policy. Services are also governed by all applicable laws, Unity’s Terms and Conditions of Use, and when applicable the terms set forth in Subscriber Site’s Privacy Policy, Supplemental Disclosures made part of this Privacy Policy and any other published rules pertaining to a particular Subscriber Site from which you access, use or download the branded Services.
Certain Services, such as WonderBar and the Health Risk Assessment are governed by additional privacy provisions (“Supplemental Disclosures”). These Supplemental Disclosures are posted at the bottom of this Privacy Policy and adjacent to the particular Services at the time information is collected.
Please read this Privacy Policy, the Supplemental Disclosures and the privacy policies of your Subscriber Site.
Types of Information Collected.
Unity may gather and maintain the following types of information:
Personally Identifiable Information (“PII” also called “Personal Information”) means information that can be used to identify a specific individual, and may include but is not limited to: name, address, email address, phone number, or credit or debit card number, as well as other non-public information that is associate with the PII.
Personal Health Information (“PHI”) means known medical conditions or health characteristics when combined with PII, but does not necessarily include health topics you are interested in, which in the absence of a known medical condition or health characteristic is Non-Personal Information.
Non-Personal Information means and may include but is not limited to information collected passively through the use of technology such as cookies, beacons, algorithms as well as information you provide that is not traceable back to you and cannot be used to identify a specific individual, including: gender, age, marital status, household income, city and state, when such user provided information is not associated with or linked to your PII.
Aggregated Information means combining Non-Personal Information collected from large numbers of users of Unity Services into aggregated statistical data and information.
How Unity Gathers Information.
Unity gathers information in three ways: (i) information you voluntarily submit during your registration and use of the Services, (ii) information through your use of the Services, and (iii) information from third parties, including Subscriber Sites.
Some of the areas where the collection of information you voluntarily provide may take place are listed below:
Registration: In order to use the Services, Unity will ask you to register for the Services on behalf of your Subscriber Site. During this registration process Unity may ask you to provide Personally Identifiable Information, select a screen name and password and ask you to provide Unity with additional Non-Personal Information so that Unity can provide you with a more personalized experience. Unity retains your registration data along with your user ID on behalf of your Subscriber Site to provide ease of access to the Services.
Public Areas: If you engage in a Public Area you may add to your profile, ask or answer questions, provide comments, videos, photographs and other content. Please review the section below entitled “Public Areas - Blogs/Social Networking/Message Boards/Interactive Forum” for further details.
Share Feature: You may voluntarily access features that will provide the users access to a tell-a-friend functionality, allowing the user to send an e-mail notification to a friend about a particular Service. In so doing Unity collects your friend’s email address, your name and your email address and automatically sends your friend a one-time-email describing the Unity Services, referencing your name and email address. Your friend may contact Unity at This e-mail address is being protected from spambots. You need JavaScript enabled to view it or This e-mail address is being protected from spambots. You need JavaScript enabled to view it to request deletion of his/her email from our database.
Health Risk Assessment: In order to use some of the Services, such as a Health Risk Assessment or Subscriber Sites (i.e. hospitals, health care providers and health plan providers), you may be asked to provide information about your known medical conditions or health characteristics. When you provide this information in certain circumstances Unity will associate it with Personally Identifiable Information and such information will become “Personal Health Information” (“PHI”). Please review the Supplemental Disclosures set forth below pertaining to the Health Risk Assessment.
Customer Support Interactions: You may provide certain Personally Identifiable Information in the course of customer service interactions.
Information Unity collects through your use of the Services:
Unity receives and stores certain types of information as you interact with the Services. For example, like many websites and online services, we use various technologies such as cookies, algorithms, beacons and log files to learn and analyze what content you viewed and searched for, your login information, email address, password, computer and connection information such as browser type, use history, date, time and click stream data from the Service. Unity may also use Server logs to capture certain Non-Personal Information such as the operating system being used, or the IP address. This information is generally used to help Unity plan for system enhancements and understand which content and Services are compatible with users’ web browsing systems. Your IP address is a number that is assigned by your Internet Service Provider to your computer to identify its location. Unity generally uses your IP address to help diagnose problems with our server and administer the Services. Unity may also use the IP address to communicate with users, and Subscribers, possibly ban those users who are not complying with the Unity’s Terms and Conditions of Use. Unity may also use the IP address to assist in delivering geographically targeted content and information.
Information we receive from third parties:
In addition to information that you provide or we collect through the Services, we may verify or collect certain information about you from third parties, including your Subscriber Site. We may combine this third party information with information we have already collected from you via the Site the Services. Unity will protect and use this third party information in conformance with this Privacy Policy in the same way that we treat other information.
How Unity Uses the Information Collected.
In general, Unity uses the information it collects as necessary or appropriate to:
Disclosure of Information Unity Collects.
Unity shares the information collected from your use of the branded Service with the Subscriber Site through which you access the Service, but does not otherwise sell, rent, or share your PII or PHI with third parties except as specifically approved or under the circumstances described below. If you do not want Unity to use or disclose PII or PHI collected about you in the ways identified in this Policy, you should not use the Services.
Non-Personal and Aggregated Information: Unity may share Non-Personal and Aggregated Information about you with third parties. Depending on the circumstances we may or may not charge third parties for this aggregated information, or limit the third parties’ use of the Non-Personal and Aggregated Information.
Personal Information and Personal Health Information may be shared as follows:
Within Unity, Unity Affiliates: Unity together with its subsidiaries or affiliates reserves the right to transfer some or all of the PII, PHI, Non-Personal Information and Aggregated Information which you provide (or which has been gathered from third parties) with any of its subsidiaries, joint ventures, affiliated entities and other companies under common control, in which case Unity will require them to honor this Privacy Policy.
Subscriber Sites: The Services are generally made available through Subscriber Sites that license the right to provide access to a branded version of the Services powered by Unity. Unity will share all information gathered through your use of the branded Service, including your PII, PHI and Non-Personal Information and Aggregated Information with the Subscriber Site you have chosen to register, access, and use and/or download the branded Services through. Unity may retain your registration data along with your user ID to provide ease of access to the Services. Although Unity will retain PII and Aggregated Information collected about users from the branded Services accessed through each Subscriber Sites, such information will also be shared with each such Subscriber Site and the Subscriber’s Sites use of such user information is subject to its own privacy policies and practices. Unity does not monitor, control or endorse the information collection or privacy practices of any Subscriber Site. You acknowledge and agree that Unity is not responsible for the legality, accuracy or inappropriate nature of any privacy practice, or use made of your PII, PHI, Non-Personal and Aggregated Information by Subscriber Sites or other third party sites linked to Subscriber Sites. To the extent that you wish to avail yourself of the health, wellness and medical related Services through means of the Health Risk Assessment or other health or wellness related Services, Unity will be required to share certain PII and PHI with the Subscriber Site through which you have chosen to use, access and download the Health Risk Assessment or other health, or wellness Services.
Agents, Service Providers and Contractors: Unity may share or transfer the information it collects with vendors, service providers, contractors, authorized third party agents acting on behalf of Unity and who help operate our business, and Services. Examples of such service providers include third parties that provide processing, storage, technical or fulfillment services, data analysis, payment processing (including credit card payments) customer service, and sending emails third parties who create, or provide the Services contained therein.
Legal Reasons: Unity may release account and any other information it collects about you to third parties: (i) to comply with applicable laws, or regulations, or pursuant to a court order, search warrant or other similar order, or subpoena; (ii) as deemed necessary in Unity’s discretion, to investigate, take action, prevent and protect the legal rights or property of Unity and its users; (iii) prevent harm, fraud, illegal conduct; (iv) a threat to homeland security; (v) to prevent a violation of this Privacy Policy, Unity’s Terms and Conditions of Use and Subscriber Sites privacy policies and Terms of Use. Unity may also choose to establish or exercise our legal rights or defend against legal claims and use your PII in this regard as appropriate.
Disclosure in the event of changes to Unity: Unity, together with its parent, subsidiaries or affiliate entities reserves the right to transfer some or all of the PII, PHI, Non-Personal Information and Aggregated Information you provide to Unity or which has been gathered from third parties and Subscriber Sites and any other information, among the assets transferred, in the event Unity’s undergoes a business transaction such as a merger or an acquisition by another company in which all or a portion of Unity’s assets are transferred; or undergoes a bankruptcy, reorganization or enters receivership.
Public Areas - Blogs/Social Networking/Message Boards/Interactive Forum.
The Services may include message boards, chat rooms, profiles, interactive forums and social networking environments (collectively referred in this Privacy Policy as “Public Areas”). Please be aware that Unity makes no commitment to monitor these Public Areas. If you choose to participate in Public Areas, you should be aware that the personal and other information you provide there will be made broadly available to others and can be read, collected or used by other users of these Public Areas, both within and outside of the Services and by the Subscriber Sites who will have access to Public Areas. Certain Public Areas may have additional rules and conditions. With respect to the Public Areas found within Services and Services used, accessed or downloaded through Subscriber Sites, the Services may provide each Subscriber Site (not the user) with the ability to determine the privacy setting with respect to user generated content (“User Content”) within the branded Services. The privacy setting determines whether and who can view the User Content. Unity will abide by the privacy settings dictated by the Subscriber Site or as the case may be the user, provided however that Unity may release such User Content: (a) as required by order of a government agency or court of competent jurisdiction; (b) to comply with legal process; (c) if necessary to enforce the terms of this Privacy Policy or the Unity Terms and Conditions of Use; (d) to respond to a good faith belief or third party claims that such contents violate the rights or interests of a third party; (e) to protect the rights or property of Unity, other users, and a Subscriber Sites. Please carefully review the privacy setting for each Service prior to accessing the Service /or providing User Content.
Because of the public nature of the Public Areas it is important to exercise caution when deciding to reveal PII and PHI in Public Areas. By using Public Areas, you agree that neither Unity, nor your Subscriber Site is responsible for any information that you disclose or communicate in such Public Areas and any disclosures you make at your own risk.
Unity and your Subscriber Site may decide to utilize the User Content from Public Areas that you provide, such as Q&A’s, interactions with experts and/or chat room and message board content, video, photographs and text. By posting to any Public Area, or by otherwise asking questions and sending comments through the Services, you automatically grant to Unity and your Subscriber Site, a perpetual, world-wide, royalty-free, irrevocable, non-exclusive license to use, reproduce, modify, publish, edit, translate, distribute, perform, and display the messages, questions, photographs, comments, or any part thereof, alone or as part of other works, in any form, media, or technology, whether now known or hereafter developed and to sublicense such rights through multiple tiers of sublicenses.
Third Party Links.
To the extent the Services or Subscriber Sites link to outside services and resources, Unity does not control the availability and content of those outside services and resources. Unity does not endorse, monitor, control or make any representations about these third party sites, or any material found on them, or any results that may be obtained from using them or their information and privacy practices. If you decide to access any of these third party websites you do so entirely at your own risk. You acknowledge and agree that Unity is not responsible for the legality, accuracy or inappropriate nature of any content, advertising, Services, or other material on or available third party linked sites. Any concerns regarding any such service or resource, or any links thereto, should be directed to the particular service or resource.
Changes to this Privacy Policy Generally.
Unity reserves the right to make non-significant changes to this Privacy Policy that will not affect Unity’s use of PII at any time without any notice to you other than posting any such changes in the revised Privacy Policy on the Unity website and linked from those branded Services for which this policy applies. Unity may modify this Privacy Policy at any time so please review it frequently. If Unity makes material changes to this Privacy Policy that affect the use of PII, Unity will notify you. Material changes to this Privacy Policy mean changes that expand the permissible uses or disclosures of PII from the manner in which such information was allowed under the previous Privacy Policys. You may choose to opt-out of continuing to use the Services by existing Services immediately. Your continued use of the Services signifies your acceptance of the changes to this Privacy Policy. In instances where we ask for your PII and we tell you through Supplemental Disclosures or other legal notices that the data collected on that page will be shared with unaffiliated third parties, including Subscriber Sites or in a manner that is inconsistent with this Privacy Policy those disclosures will override anything to the contrary in this Privacy Policy.
Changes to this Privacy Policy Affecting your Personal Health Information.
If a material change in this Privacy Policy involves the use of your PHI, your express opt-in permission will be asked for. If you choose not to accept the changes to this Privacy Policy, the current Privacy Policy terms and conditions will remain in effect for the period of time in which the specific health related Service is made available.
Guidelines Regarding Children.
Unity does not knowingly collect PII from individuals under thirteen years of age. If we learn that we have collected PII on a child under the age of 13, we will delete that data from our systems. Anyone under the age of 18 are discouraged from participating in any Services, Public Areas or content related to sex or sexual health.
Security of Personally Identifiable Information and Personal Health Information.
Unity is committed to protecting the PII and PHI that you share with us. When we transfer sensitive personal data over the internet (i.e., credit card or PHI) we protect it using secure socket layer (SSL) encryption. Unity utilizes commercially acceptable means and industry standard technologies to help protect your PII from unauthorized access, use or disclosure. Please understand however, that no method of transmission over the Internet or method of electronic storage is 100% secure and therefore Unity cannot guarantee its security. Please take every precaution to protect your PII and PHI when you are on the Internet.
Applicable Law.
Unity makes no representation or warranty that the content and materials on the Services are appropriate or available for use in locations outside the United States. The Services are controlled and operated from the United States. The Services are not intended to subject Unity to the laws or jurisdiction of any state, county or territory other than that of the United States. Those who choose to access the Services do so at their own initiative and are responsible for complying with all local laws, rules and regulations.
Correcting, Updating and Controlling Personally Identifiable Information.
Unity provides Users with the ability to access, correct, change or remove the information you have submitted by going back to the Service as the case may be and logging into your account and making the change. If you no longer desire to use or access a particular Services, you may remove the PII from your account. Unity may store and retain both the information you have provided (PII and/or PHI) in an active database or an inactive back up medium. Please be aware that even if you delete your information from Unity
records, there is residual information that will remain in Unity’s database, access logs and other records, which may or may not contain PII. Unity is not responsible for updating or removing any information within database or lists of Subscriber Sites, or other third parties permitted to receive such information pursuant to this Privacy Policy as a result of your access to the Services. When you receive promotional communication from Unity you will have an opportunity to opt-out by following the unsubscribe instructions provided in the promotional email, you receive, or editing your preference to receive these communications when you are logged in as a registered user. Regardless of the preference you select, Unity may continue to send you administrative emails, or contact you in any other manner regarding updates to policies or administrative matters pertaining to the Services.
Supplemental Disclosures.
The Health Risk Assessment: Unity provides access to the Services, customized for use by Subscriber Sites within the health care, medical and health plan provider. The Services offered through certain Subscriber Sites allow access to the Health Risk Assessment and other health and wellness related services in order to better manage your health. Unity and the Subscriber Site from which you access the Services may tailor information you receive through the Services to reflect your interests, concerns and personal health characteristics. The Health Risk Assessment (“HRA”) will require additional registration. PHI that you enter into the HRA or any other health or wellness related Service are intended to provide personalized, relevant information, however this information is intended to supplement and not substitute for the expertise and judgment of health care professions. The HRA gathers the PHI you provide and may store PHI coming from third party data agreements with your Subscriber Site from which you access the HRA. Unity maintains and limits its use of PHI to the opt-in permission you provide at the time you registered for the HRA and provide details regarding the ability to update PHI and provide details with respect to limitations on removing or changing PHI. Please note however that Unity may combine, in a non-identifiable format, the PHI you provide with the information from other users to create Aggregate Information that may be disclosed to third parties.
WonderBar: The WonderBar is a branded application offered via the http://unity.mywonderbar.com website or through Subscriber Sites that wish to provide certain features and functionality to its users. The Subscriber Site from which you obtain access to the branded WonderBar selects the features and content provided to you Unity’s use of PII such as your log in credentials will be collected through the WonderBar, and Aggregated Information is collected through your use of the WonderBar is governed by the terms of this Privacy Policy. The Subscriber Site’s use of information collected through the WonderBar shall be governed by Subscriber Site’s Privacy Policy displayed or linked from the branded WonderBar.
No Spyware/Adware: The WonderBar does not collect or transmit PII through means of Spyware, does not modify pages visited by users nor does it enable application to access data in online accounts without permission and does not require exposure to unwanted advertising.
Unobtrusive: The WonderBar does not enable other applications to access data stored on your computer’s hard drive or in your online accounts and it does not modify pages you visit or modify search experience.
Uninstall: The WonderBar can be easily uninstalled by using standard uninstall process as may be available as part of your Internet browser, software uninstall options or your computer’s operating systems.
Deactivation: The WonderBar can be easily deactivated at any time by using standard deactivation features available as part of your Internet browser.
