Unity Corporation, Inc. (“Unity) offers third parties a variety of software as services platforms that currently include: jLog, WonderBar, Smart Assessment Tool and Ask an Expert (the “Unity Services”), using their brand and sometimes their content.  As a provider of software service platforms, users generally access and use the Unity Services through a third party.

Please take a moment to review this Corporate Privacy Policy.  This Privacy Policy is provided so that Unity may inform you about how the Unity Services process information on behalf of corporate and healthcare clients that license the Unity Services to provide access to Unity Services in a branded environment to their end users via their websites (“Subscribing Website(s)”).  As a Subscribing Website or visitor to this Unity website site, you agree to this Corporate Privacy Policy in its entirety when you access the Unity Website.  If you do not agree with the terms and conditions of this Privacy Policy, please do not use or access the Unity Website or Unity Services.

We control and operate this Website and the Unity Services from the United States.  Neither this site nor Unity Services are intended to subject Unity to the laws or jurisdictions of any state, country or territory other than that of the United States.  Please note that Unity does not represent or warrant that this Website or Unity Services are appropriate for use in any particular jurisdiction.  Those of you who choose to access this Website and Unity Services from a country other than the United States agree that the laws, rules and regulations of the United States shall govern any dispute including those arising from Unity’s use of Personally Identifiable Information or otherwise relating to privacy, even if such rules are less stringent than the laws of your country.

As used in this Privacy Policy, “Personally Identifiable Information”  (“PII”) means information about you that is personally identifiable, like your name, address, email address, or phone number, as well as other non-public information that is associated with your personal information.  The term “Anonymous Information” means information that does not identify an individual or provide the means for contacting an individual and is not associated with or linked to your PII.

The Information We Gather.

We do not require visitors to the Website to provide Unity with PII in order to view the content on this Website or to browse other available Unity Services.  However if you become a Unity Subscriber Site or you access the Unity Services directly from this Website, we may collect PII as more fully explained in the Consumer Privacy Policy and detailed below in Privacy Policy for Services.  Unity does collect PII from this Website when you attempt to become a Subscribing Website and/or otherwise choose to provide PII, such as through a registration form, questionnaire or email communication.  If you send Unity personal correspondence such as e-mails or letters or if other users or third parties send correspondence to Unity about your activities or postings on this Website, Unity may collect such information into a file specific about you.  All such submissions become the property of Unity and will be kept by Unity for a reasonable period of time as dictated by Unity customary record keeping retention practices. Unity collects Anonymous Information from visitors to Unity Services and such information may include IP host address, pages viewed, browser type, Internet Service Provider, domain name, time and date of visit to the Website, URL and/or computer operating systems.

Information Sharing.

Unity will not sell or rent your PII collected on the Website, or share it with third parties except in the following instances:

• as necessary to conduct business activities;
• in the case of a breach of any agreement between Unity and a Subscribing Website;
• where required by law, or requested by a court of competent jurisdiction;
• in the case of a bankruptcy, receivership, liquidation or transfer of substantially all of its assets;
• if Unity undergoes a sale, merger, consolidation, or a change in control; or
• when Unity determines in its sole discretion that such disclosure is necessary to protect the rights of Unity, its affiliates or subsidiaries, or to protect Unity from liabilities.

Minors.

This Website is not intended for visitors that are under 18 years of age and does not knowingly solicit or collect information from individuals under the age of 18.

Security.

All information is stored in a technically and physically secure environment.  No data transmission over the Internet can be guaranteed to be 100% secure, and while Unity strives to use commercially-acceptable means to protect your Personal Information, Unity cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk.

Changes to this Privacy Policy.

Unity reserves the right to change, modify, add or remove portions of this Privacy Policy at any time and without prior notice, and any changes will become effective immediately upon being posted unless we advise you otherwise.  However, we will not use your Personal Information in a way that is materially different than the uses described in this Privacy Policy without giving you an opportunity to opt-out of such differing uses.  Your continued use of this Website after this Privacy Policy has been amended shall be deemed to be your continued acceptance of the terms and conditions of this Policy, as amended. We encourage you to review this Privacy Policy often.

Privacy Practices Applicable to Consumer Users of Unity Services.

Unity’s clients are primarily businesses that are given licensed use of Unity Services and are provided access to consumer users within private-labeled environments accessible via the client’s website (each a “Subscriber Site”).  The Subscriber Site does not collect PII from users of such privately labeled versions of Unity Services. PII and Anonymous Information is collected by Unity and then shared with the Subscriber Site based upon the terms set forth in the Consumer Privacy Policy. The consumer may see both the Unity brand and/or the client brand as part of the registration process to access Unity Services.  The Consumer Privacy Policy provides details regarding Unity practices about information collected and received from Users as well as the ways in which Unity processes and sometimes shares such information.
